These Terms of Service govern your use of the Data2Bids platform ("the Service"). By accessing or using the Service, you agree to these Terms.
1. Accounts and Access Control
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity performed under your account or your organization's workspace.
- You must ensure that only authorized team members access connected cloud storage accounts or sensitive project data.
- If we detect unauthorized access, misuse, or security risks, we may suspend or restrict access to protect data integrity.
2. Use of Service
You agree not to:
- Upload unlawful, infringing, or harmful content.
- Violate intellectual property rights of third parties.
- Process documents or datasets for which you lack authorization.
- Attempt to access folders, files, or cloud storage areas outside those explicitly approved by the user.
- Interfere with or disrupt the Service, servers, or security systems.
Data2Bids may suspend or terminate access for abuse, security concerns, non-payment, or legal obligations.
3. Document Processing and Data Handling
By using the Service, you authorize Data2Bids to:
- Read and process the folders and files you explicitly select.
- Extract text, indexes, drawings, measurements, and related project information.
- Generate searchable datasets, AI summaries, and digitized outputs.
All processing is limited to the files you authorize. We do not access or modify other folders in your cloud storage.
All data usage follows the Privacy Policy, which is incorporated into these Terms.
4. Payments, Billing, and Subscriptions
- Payments are securely processed through Stripe or PayPal.
- Data2Bids does not collect or store card numbers, CVV, or bank information.
- All payment data is handled by Stripe under PCI-DSS Level 1 compliance.
- By subscribing, you authorize automatic recurring charges until you cancel.
- You may cancel your subscription at any time from your account settings.
- Refunds, disputes, and billing adjustments follow Stripe's policies.
- If a payment attempt fails, we may suspend access until the issue is resolved.
Future Payment Providers
If additional payment processors are added, the same principles apply: payment data remains stored and managed exclusively by the respective provider, not by Data2Bids.
5. AI Tools and Limitations
Data2Bids uses Artificial Intelligence to analyze documents and provide answers.
AI-generated outputs:
- May contain errors, omissions, or misinterpretations.
- Are not legal, financial, engineering, or professional advice.
- Must be independently verified before making decisions.
You agree that all decisions based on AI-generated results are your responsibility.
6. External Data Sources and Licenses
The Service may interface with third-party data sources (e.g., pricing databases, reference datasets, or external catalogs).
When such connections exist:
- You must ensure you have the legal right to access and use those datasets.
- Data2Bids processes such datasets only for functionality within the Service.
- Data2Bids does not redistribute licensed datasets to any party.
This section ensures future integrations are legally compliant without naming any providers.
7. Limitation of Liability
To the fullest extent permitted by law:
- Data2Bids is not liable for any loss of data, revenue, profits, business opportunities, or damages arising from use of the platform.
- Data2Bids is not responsible for errors in AI-generated outputs, user-uploaded content, or cloud provider outages.
- You expressly waive any claims for consequential, indirect, incidental, or punitive damages.
- Your sole remedy for dissatisfaction with the Service is to discontinue use.
8. Changes to the Service or Terms
- We may update these Terms from time to time.
- If updates occur, we will notify users through the platform or email.
- Continued use after notice constitutes acceptance of the revised Terms.
9. Cancellation and Termination
You may cancel your subscription at any time.
We may suspend or terminate accounts for:
- Non-payment
- Misuse or abuse
- Legal requirements
- Security risks
- Violations of these Terms
Upon termination, access to the Service and processed data may be restricted or deleted according to our retention policies.
10. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in state or federal courts located in Miami-Dade County, Florida.
